Lost at re-determination? The tribunal looks at everything again.
An ADP tribunal is an independent hearing at the First-tier Tribunal for Scotland (Social Security Chamber), not Social Security Scotland. The panel is a legally qualified convener, a medical member and a disability member. It looks at your points again, activity by activity.
It’s not a courtroom. No wigs. No dock. No rows of spectators. Most hearings take place in a small, quiet room with a table and a few chairs. The panel’s job is to understand how your condition affects you — not to catch you out.
31 days from the date on your re-determination letter to send your appeal. A late appeal can be accepted up to a year with a good reason.
Every activity, every point, argued for the panel.
Points are won activity by activity. We argue every one that fits your case.
Every activity, scored
The descriptor that fits you for each daily living and mobility activity, with the points it carries, to reach 8 or 12.
The reliability rules
You can only count as able to do something if you can do it safely, to an acceptable standard, repeatedly and in a reasonable time.
More than half the time
A descriptor applies if it fits you on more than 50% of days. We show how often, with your own examples.
The decision, challenged
Where the consultation report, the decision or the re-determination got it wrong, we point it out.
Three people, a table, and no court.

ADP and PIP: what’s different.
The points are the same. The rules, deadlines and help along the way are not.
| What | ADP (Scotland) | PIP (England and Wales) |
|---|---|---|
| Who decides | Social Security Scotland | The DWP |
| First challenge | Re-determination | Mandatory reconsideration |
| Time to ask | 42 days | One month |
| Time to decide | 56 days, or you can appeal straight away | No fixed limit |
| Appeal to | First-tier Tribunal for Scotland | First-tier Tribunal (SSCS) |
| Time to appeal | 31 days | One month |
| Help while you challenge | Short-term Assistance, if an existing award was cut or stopped | None |
| Activities and points | The same 12 activities, 8 and 12 points | The same 12 activities, 8 and 12 points |
Different rules, different deadlines. A letter written for PIP gets the details wrong.

Re: Your ADP tribunal submission — what’s inside.
- A personalised tribunal submission — built from your decision, your re-determination letter, your consultation report if you had one, and your evidence. Not a template.
- Every activity argued — daily living and mobility, against the descriptors and the points they carry, to reach 8 or 12.
- The reliability rules applied — safely, to an acceptable standard, repeatedly and in a reasonable time, with the more-than-half-the-time rule.
- The re-determination challenged — point by point, where it got your points wrong.
- Your evidence referenced — so the panel can find what supports each activity.
- A step-by-step submission guide — how to send your appeal and what happens next. Free revisions included.

Points to pounds, a week.
ADP uses the same activities and points as PIP. 8 points gets the standard rate, 12 the enhanced rate, for each part.
| Part | Standard 8 to 11 points | Enhanced 12 points or more |
|---|---|---|
| Daily living | £76.70 | £114.60 |
| Mobility | £30.30 | £80.00 |
| Both parts | £107.00 | £194.60 |
A few points can be the difference between rates. Moving from standard to enhanced on both parts is worth £87.60 a week, about £4,555 a year.

What happens after the tribunal.
Most hearings end with a decision the same day. Two outcomes that matter.
Win on the day
The tribunal decides your points and rates, and Social Security Scotland puts the decision into effect, backdated.
No decision on the day
Doesn’t mean you’ve lost. The case may be complex, or the panel may want more evidence. You’ll get the decision in writing, or a new hearing date.
Haven’t asked for a re-determination yet? You’ll need to do that first, see our ADP re-determination letter (£49, same as this one). Live in England or Wales? See our PIP tribunal letter, or all our services.
Questions about an ADP tribunal appeal.
If your question isn’t covered, email us at support@pipappeal.org.uk and we’ll reply same day.
A legally qualified convener, a medical member and a disability member ask about the activities you find hard. The hearing isn’t very formal, and it isn’t a court. Describe your typical or worst days, not your best.
Yes. The tribunal looks at the decision again, activity by activity, and decides the points and rates itself. Your submission sets out the points you should have for each activity.
No. The appeal can be decided on the papers instead, but going lets the panel ask you what the papers can’t say. Hearings can be in person, by video or by phone.
Yes. A family member or friend can come with you for support, and you can have a representative if you want one.
Every activity that applies, in daily living and mobility, argued against the descriptors and points; the reliability rules and the more-than-half-the-time rule; and the re-determination challenged point by point, with your evidence referenced. It comes as a PDF and a Word document with free revisions.
No. We write the submission the panel reads before your hearing. If you want someone to represent you in person, Citizens Advice Scotland and local welfare rights services may be able to help free of charge.
On the appeal form that came with your re-determination letter, within 31 days. Your submission comes with a step-by-step guide. mygov.scot explains how to challenge a decision.
If an award you’ve had for a while was reduced or stopped, you can apply for Short-term Assistance, which tops your payment back up while the appeal goes on. It isn’t available on a new application.
Social Security Scotland has 31 days to respond, then you have 31 days to reply to its response. The tribunal then decides how to deal with the case, usually at a hearing, and gives at least 14 days’ notice.
Yes, as long as it’s within a year. A late appeal needs a good reason, such as being too unwell or in hospital, and your submission includes that explanation.
