Lost at MR? The tribunal looks at everything again.
A WCA tribunal is an independent hearing at the First-tier Tribunal (Social Security and Child Support), run by HMCTS, not the DWP. The panel is a judge and a doctor. It can put you in the LCWRA group even on a fit for work appeal.
It’s not a courtroom. No wigs. No dock. No rows of spectators. Most hearings take place in a small, quiet room with a table and a few chairs. The panel’s job is to understand how your condition affects you — not to catch you out.
One calendar month from the date on your Mandatory Reconsideration Notice to send your appeal (SSCS1) to HMCTS. Late appeals are possible up to 13 months with a good reason.
Every route to the right group, in the order the tribunal needs.
LCWRA first, then limited capability for work, then substantial risk.
The LCWRA group, first
The Schedule 7 descriptors that bring the health element. Points don’t count here, one descriptor most of the time does.
Every activity, scored
Each activity that applies, argued against the Schedule 6 descriptors to reach the 15 points for limited capability for work.
Substantial risk, in the alternative
If finding you fit for work would put your health at substantial risk, you can qualify regardless of points. We argue it with the case law.
The assessment report, challenged
Where the UC85 or ESA85 contradicts itself, records what you didn’t say, or skips the questions that mattered, we point it out.
Two people, a table, and no wigs.

Fit for work, LCW or LCWRA: what each means.
The group you’re put in decides your work requirements and, for most people, whether Universal Credit pays anything extra.
| What | Fit for work | LCW | LCWRA |
|---|---|---|---|
| Work requirements | Look for and prepare for work | Prepare for work only | None |
| Extra money in Universal Credit | None | None, for most claims | £217.26 a month, or £429.80 for earlier claims and severe conditions |
| How you get there | Under 15 points | 15 points or more | One LCWRA descriptor, most of the time |
The tribunal can put you in LCWRA even on a fit for work appeal.

Re: Your WCA tribunal submission — what’s inside.
- A personalised tribunal submission — built from your decision, your Mandatory Reconsideration Notice, your assessment report and your evidence. Not a template.
- The LCWRA group argued first — the Schedule 7 descriptors that bring the health element, where they fit your case.
- Every activity argued — against the Schedule 6 descriptors, with the majority-of-the-time rule applied to each.
- Substantial risk, in the alternative — with the case law, because the form and the assessment never ask about it.
- Your assessment report challenged — point by point, and your evidence referenced so the panel can find it.
- A step-by-step submission guide — how to send it to HMCTS and what happens next. Free revisions included.
What happens next: secure card payment → tell us about your case and upload your MR notice and report → we draft and deliver within 48 hours. Add 24-hour delivery (£19) or a Letter to Your GP (£9) at checkout.
Your appeal, start to finish.
What happens after you send your appeal, and where your submission does its work.
Step 1 · You lodge the appeal
The SSCS1 form goes to HM Courts and Tribunals Service, within one month of your mandatory reconsideration notice.
Step 2 · Your bundle arrives
The DWP sends its response: everything in your file, including the assessor’s report. Your submission answers it, point by point.
Your submission helps hereStep 3 · You wait
Send new evidence as it arrives. After reading a proper submission, the DWP sometimes makes an offer before the hearing.
Step 4 · Your hearing date
You get at least 14 days’ notice. Two weeks to send any new evidence and plan who comes with you.
Your submission helps hereStep 5 · The hearing
Thirty to sixty minutes of questions. The panel has read your submission first.

Usually the same day. If you win, the DWP must put it into effect, with back pay.

What happens after the tribunal.
Most hearings end with a decision the same day. Two outcomes that matter.
Win on the day
The tribunal decides your group. If it’s LCWRA, the health element is added to your Universal Credit, backdated to the decision you challenged, and your work requirements are removed.
No decision on the day
Doesn’t mean you’ve lost. The case may be complex, or the panel may have run out of time. You’ll receive the decision by post within a week, sometimes faster on the HMCTS online portal. Either way, you’ll know within days.
Haven’t done a mandatory reconsideration yet? For Universal Credit you’ll need to do that first, see our WCA reconsideration letter (£49, same as this one). Still to send your WCA50? See WCA50 form help, or all our services.
Questions about a WCA tribunal appeal.
If your question isn’t covered, email us at support@pipappeal.org.uk and we’ll reply same day.
A judge and a doctor ask about your health and your daily life, and how the activities affect you. They compare your answers with the assessment report and your appeal papers. Describe your typical or worst days, not your best.
Yes. The tribunal looks at the whole decision again and can award the LCWRA group even on a fit for work appeal. Your submission asks for LCWRA first, then limited capability for work, then substantial risk.
Most hearings last under an hour. The panel usually gives its decision on the day, or by post soon after.
Yes. A friend, family member or carer can come with you for support. The panel will mostly want to hear from you.
Every activity that applies, argued against the descriptors with the majority-of-the-time rule; the LCWRA group; substantial risk in the alternative, with the case law; the severe conditions criteria where they apply; and your assessment report challenged point by point. It asks for a hearing, and comes as a PDF and a Word document with free revisions.
No. We write the submission the panel reads before your hearing. If you want someone to represent you in person, Citizens Advice and local welfare rights services may be able to help free of charge.
You send the SSCS1 appeal form to HMCTS, online or by post, within one month of your Mandatory Reconsideration Notice. Your submission comes with a step-by-step guide. GOV.UK explains how to appeal a benefit decision.
Yes. The free WCA preview shows where you stand on points, your deadline, and your hardest activity argued, within 3 hours.
Universal Credit carries on while you appeal, but without the health element. New Style ESA can be paid again at the assessment rate once your appeal is registered with HMCTS, as long as you keep sending fit notes.
You receive a written decision and can ask for a statement of reasons within one month. You can only appeal further to the Upper Tribunal on a point of law.
Yes, as long as you’re within 13 months of your Mandatory Reconsideration Notice. A late appeal needs a good reason, such as being too unwell to act, and your submission includes that explanation.
